1) Who We Are & How These Terms and Conditions Work
These Terms and Conditions (“Terms”) govern access to and use of the Skin Smart website, mobile applications, and related services (collectively, the “Platform”). The Platform is owned Fatmah Abdullah Saeed Almaddah Commercial Establishment, with its registered address in Jeddah, Saudi Arabia (“Skin Smart”, “we”, “us”, “our”).
By creating an account, purchasing through the Platform, using community/social features, or interacting with our AI tools, you agree to these Terms, our Privacy Policy, our Community, Communications & Reviews Policy, our Exchange & Refund Policy, our Cookie Policy, any other policy listed on our Platform, and any feature-specific Terms and Conditions (collectively, the “Agreements”).
If you do not agree, do not use the Platform.

2) Definitions
- Account: Your registered profile on the Platform.
- Community Content / UGC: Any content you or other users post (photos, videos, comments, reviews, DMs, profiles, routines).
- Retailer: An independent seller listing and fulfilling products through the Platform.
- Skin Smart Shop: Products sold and fulfilled directly by Skin Smart.
- Order: Your product purchase via the Platform.
- RMA: Return Merchandise Authorization issued for approved returns.
- Loyalty Program: Skin Smart’s rewards/tier program described in §16.
3) Scope; Eligibility; Accounts
3.1 Territory & Languages. We primarily serve users in the Kingdom of Saudi Arabia and the GCC. The Platform is bilingual (Arabic/English).
3.2 Eligibility. You must be legally able to form a binding contract and meet the minimum digital consent age for your jurisdiction. Some features require 18+.
3.3 Account Security. Keep your credentials confidential. You are responsible for activity under your Account. Notify support@skinsmart.io of any suspected compromise.
3.4 One Person, One Account. No false identities or multiple accounts intended to evade restrictions or manipulate promotions.
4) Nature of the Platform (Intermediary)
4.1 Marketplace Intermediary. Except for Skin Smart Shop items, Skin Smart is not the seller of record. Retailers independently list, fulfill, and own responsibility for their products and policies, subject to our minimum standards.
4.2 Payments & Settlement. Skin Smart acts as a payment intermediary: we collect the full Order amount from you, deduct our commission, and remit the balance to the Retailer.
4.3 No Professional Advice. AI outputs, articles, product description, community posts, and routines are educational only and not medical advice. Always consult qualified professionals for diagnosis or treatment.
5) Use of the Platform
5.1 Permitted Use. Personal, non-commercial use only unless we provide written permission (e.g., creator/affiliate tools).
5.2 Prohibited Conduct. You agree not to:
- violate laws or infringe rights (privacy, IP, publicity);
- post harmful, harassing, hateful, or unsafe content;
- make unsubstantiated medical or performance claims;
- engage in spam, scams, impersonation, scraping, reverse engineering, or security testing without written authorization;
- bypass or disable safety features or content filters.
5.3 Technical Requirements. You need compatible devices, software, and internet access. Performance may vary by device, OS, and region.
5.4 Suspension/Termination. We may restrict or terminate access for any breach, risk to users, or legal/regulatory reason.
6) Prices, Payment & Taxes
6.1 Pricing. Prices and promotions may change. Errors may occur despite reasonable efforts. If a material error affects your Order, we may contact you to confirm the corrected price or cancel and refund.
6.2 Payment Methods. Accepted methods are shown at checkout (e.g., cards, wallets, gift cards).
6.3 Currencies & FX. Displayed currencies may vary by location; settlement and FX rates are determined by payment providers at the time of charge.
6.4 Taxes & Duties. You are responsible for any applicable taxes, duties, or import charges, unless we state otherwise at checkout.
7) Orders, Acceptance & Availability
7.1 Contract Formation. Your Order is an offer. Acceptance occurs when the item is dispatched (Retailer or Skin Smart Shop) or otherwise explicitly confirmed.
7.2 Availability. We do not guarantee stock. Where items are unavailable or subject to restrictions, we may cancel and refund.
7.3 Non-Resale. Products are for personal use. We may cap quantities per person/Order/household and cancel suspected resales.
8) Delivery & Risk
8.1 Shipping. Delivery options, timelines, and fees appear at checkout and in our Shipping & Delivery Policy. Orders may arrive in separate shipments when multiple Retailers are involved.
8.2 Risk of Loss. Passes on delivery to the address you provide or on collection. Inspect parcels and refuse delivery if tampered with.
8.3 Delays. We are not liable for delays outside our control (customs, carrier, force majeure). If there is a substantial delay, you may be entitled to remedies under law or per the Exchange & Refund Policy.
9) Cancellations Before Dispatch
If you wish to cancel before dispatch, contact info@skinsmart.io within 3 hours of placing an order. If the parcel has already shipped, see Returns (§10–§12).
10) Returns, Exchanges & Refunds — Overview
Skin Smart is the central point of contact, but Retailer approval is required for Retailer-fulfilled items.
The full process is detailed in our Exchange & Refund Policy, incorporated here by reference.
10.1 Who to Contact. You may contact Skin Smart or the Retailer. In all cases, Skin Smart will connect and coordinate with the Retailer, and no refund/exchange proceeds without Retailer approval for Retailer items.
10.2 Minimum Standards. Retailers must accept returns of unused, unopened items eligible for return if reported within 7 days of delivery (hygiene exceptions apply). Some Retailers may offer more generous terms.
10.3 Damaged/Defective/Incorrect. If reported within 7 days with required evidence (photos/videos), seller bears return shipping and will replace or refund after inspection.
10.4 Refund Method. Refunds are made to the original payment method after (i) Retailer approval, and (ii) receipt/inspection per RMA instructions. Bank posting times vary.
10.5 Gifts, Points, Gift Cards. See Exchange & Refund Policy for rules on gift-with-purchase, points reversal, and digital gift card refunds.
10.6 Do Not Ship Without RMA. Returns without an RMA or to the wrong address may be rejected.
11) International Orders & Customs
11.1 Importer of Record. Depending on your destination and checkout options, you or the Retailer may be importer of record. Duties/taxes may be collected at checkout or upon delivery.
11.2 Legal Compliance. You must comply with destination import laws. We are not responsible for seizures, prohibited items, or your failure to pay import charges where required.
12) Product Information & Safety
12.1 Descriptions. We aim for accuracy, but packaging/formulations may change. Always check labels, warnings, and directions before use.
12.2 Allergies & Sensitivities. Conduct patch tests and consult professionals where appropriate. Discontinue use if irritation occurs.
12.3 Regulated Claims. Any performance/medical claims are subject to applicable law and should be substantiated by the manufacturer/retailer. Skin Smart does not guarantee outcomes.
13) AI Features & Disclaimers
13.1 Educational Only. All information on the Platform, including but not limited to AI suggestions and content personalization, are informational and not a substitute for professional medical advice, diagnosis, or treatment.
13.2 No Automated Decisions with Legal Effect. We do not make automated decisions that produce legal or similarly significant effects without human review.
13.3 Your Choices. You may object to profiling, request human review, or adjust personalization in settings (see Privacy Policy).
14) Community, Communications & Reviews
14.1 Policy Incorporated. The Community, Communications & Reviews Policy is part of these Terms. It covers who may post, quality standards, prohibited content, DM rules, disclosures for ads/gifting/affiliates, conflicts of interest, and moderation.
14.2 License to Skin Smart. By posting UGC, you grant Skin Smart a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to host, store, reproduce, distribute, adapt, publish, translate, publicly perform/display, and create derivative promotional excerpts of your UGC in connection with the Platform and its promotion.
14.3 No Duty to Monitor. We may, but are not obligated to, monitor or moderate content or communications. We may remove content or limit accounts at any time.
14.4 Brand Responses. Retailers/brands may respond to reviews. We may request proof of purchase or additional evidence before deciding whether to keep, edit for accuracy (minor spelling/punctuation only), label, or remove reviews.
14.5 Ownership. You retain ownership in your UGC; you represent you have all necessary rights/permissions (including likeness rights).
15) Intellectual Property; Platform License
15.1 Skin Smart IP. The Platform, code, logos, trademarks, designs, text, and assets are owned by Skin Smart or its licensors and are protected by law.
15.2 Limited License to You. Subject to these Terms, we grant you a non-transferable, non-exclusive, revocable license to use the Platform for personal, non-commercial purposes.
15.3 Restrictions. No copying, distribution, reverse engineering, data mining/scraping (except as permitted by law), framing, or creating derivative works without prior written consent.
16) Limitation of Liability and Dispute Allocation
16.1 Marketplace Role
Skin Smart operates as a digital platform that facilitates connections between users and independent third-party retailers. Unless explicitly stated otherwise (“Sold by Skin Smart”), Skin Smart does not manufacture, warehouse, fulfill, or ship any products listed on the platform. Retailers listed on the platform act as the sellers of record and are fully responsible for the sale, delivery, and warranty of their products.
16.2 Scope of Skin Smart’s Responsibility
Skin Smart’s obligations are limited to:
a. Providing the technological infrastructure for browsing, purchasing, and communicating with retailers;
b. Processing and transferring payments securely between users and retailers;
c. Facilitating refund and exchange coordination between users and retailers; and
d. Maintaining customer support and dispute mediation channels.
Skin Smart’s role is strictly intermediary and administrative. The platform does not assume ownership, control, or custody of products sold by third-party retailers at any stage of the transaction.
16.3 Retailer Responsibility
Each retailer featured on the Skin Smart platform is an independent merchant responsible for:
a. The accuracy of its product listings, descriptions, pricing, and availability;
b. Compliance with product labeling, safety, import, and consumer protection laws;
c. Delivery, shipping, and fulfillment (including delays, customs clearance, or courier issues); and
d. Managing product warranties, replacements, and returns in accordance with their own policies and applicable laws.
Any disputes relating to these matters must be addressed directly between the customer and the retailer. Skin Smart will facilitate communication but does not represent either party in such disputes.
16.4 No Joint Liability
Skin Smart shall not be held jointly or severally liable for:
a. Product defects, damages, authenticity, or quality;
b. Delivery delays or courier mishandling;
c. Incorrect or misleading product information provided by retailers;
d. The retailer’s breach of its obligations under applicable laws;
e. Damages resulting from the use of any third-party retailer website or external links; or
f. Any indirect, incidental, punitive, or consequential damages, including loss of profit, data, or goodwill, arising out of use of the platform or products purchased through it.
Skin Smart disclaims all warranties, express or implied, regarding products sold by retailers, including but not limited to merchantability, fitness for a particular purpose, and non-infringement.
16.5 AI and Advisory Disclaimers
Information, product recommendations, or skincare advice generated by the Skin Smart App’s AI features are provided for informational and educational purposes only and do not constitute medical advice. Users are advised to consult qualified dermatologists or healthcare professionals before acting upon any AI-generated content or recommendations. Skin Smart shall not be liable for any reliance on such content.
16.6 Payments and Refunds
Skin Smart collects payments on behalf of retailers as a payment intermediary. Once payment is confirmed, Skin Smart’s responsibility is limited to transferring the corresponding amount (minus commissions) to the retailer. Refunds or exchanges will be processed only after retailer approval. In all cases, Skin Smart’s financial liability shall be limited to the total commission earned on the disputed transaction.
16.7 Jurisdiction and Governing Law
a. All disputes, claims, or controversies arising from the use of the Skin Smart platform, including payment issues, user accounts, or data protection, shall fall under the exclusive jurisdiction of the courts of Jeddah, Kingdom of Saudi Arabia, and be governed by Saudi Arabian law.
b. Disputes relating to product performance, delivery, returns, or warranties shall be governed by the laws and jurisdiction of the retailer’s place of establishment, unless otherwise agreed between the customer and the retailer.
16.8 Indemnification
Users and Retailers agree to indemnify, defend, and hold harmless Skin Smart, its affiliates, officers, employees, agents, and contractors from and against any and all claims, losses, liabilities, damages, costs, or expenses (including reasonable legal fees) arising out of or related to:
a. Any breach of these Terms and Conditions or other applicable agreements;
b. Any misuse of the Platform, including any unlawful or fraudulent activity;
c. Any violation of applicable laws, regulations, or third-party rights;
d. Any content, materials, or user-generated content (UGC) submitted or shared through the Platform;
e. Any dispute, claim, or transaction between a User and a Retailer or between Users themselves.
16.9 Limitation of Damages
To the fullest extent permitted by law, Skin Smart’s total cumulative liability to any user or retailer for any claim arising from or relating to the platform, whether in contract, tort, or otherwise, shall not exceed the total commission received by Skin Smart for the specific transaction giving rise to the claim.
17) Loyalty Program (Overview)
Policy Incorporated. Loyalty Program Terms is part of these Terms.
17.1 Membership. Enrollment may occur automatically on account creation or by opting in. One account per person.
17.2 Tiers & Benefits. Skin Smart may offer tiers (e.g., Smart / Smarter / Smartest) with evolving benefits (points accrual, perks, partner offers).
17.3 Points. Points have no cash value, are non-transferable and may expire. Redemption rules and caps may apply (e.g., up to 50% of an Order).
17.4 Adjustments. We may add, change, or remove tiers, accrual rates, or benefits prospectively with reasonable notice. Abuse (fraud, gaming, resale) may result in forfeiture and account action.
17.5 Returns. On returns, redeemed points are re-credited where applicable; bonus points from a returned item may be reversed.
18) Third-Party Services
The Platform may include links to third-party sites, SDKs, or services (payments, analytics, messaging). We are not responsible for third-party terms, policies, content, or actions. Review their Terms and Conditions before use.
19) Disclaimers; No Warranties
To the fullest extent permitted by law, the Platform and all features (including AI and community) are provided “as is” and “as available” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant uninterrupted, error-free, or secure operation, nor that all harmful or illegal content will be identified or removed.
20) Privacy & Cookies
Your use of the Platform is subject to our Privacy Policy and Cookie Policy, which describe how we collect, use, share, transfer, and protect personal data, including with Retailers and service providers. Manage cookie preferences via [COOKIE SETTINGS LINK] and device settings.
21) Security; User Safety
We implement safeguards consistent with our Online Security Policy. You are responsible for maintaining device security, using strong passwords, and avoiding phishing or suspicious links. Report suspected fraud to support@skinsmart.io
22) Changes to the Platform or Terms
We may update features, policies, and these Terms and Conditions to reflect legal, security, or operational changes. We will post updates with an effective date and, where required, provide additional notice. Continued use after the effective date constitutes acceptance.
23) Governing Law & Jurisdiction
These Terms and Conditions are governed by the laws of the Kingdom of Saudi Arabia. You agree to the exclusive jurisdiction of the courts of Jeddah, KSA, without prejudice to any non-waivable consumer rights under applicable law.

25) Miscellaneous
25.1 Entire Agreement. These Terms and Conditions plus incorporated policies form the entire agreement between you and Skin Smart regarding the Platform.
25.2 Severability. If any provision is held invalid, the remainder remains in effect.
25.3 No Waiver. Failure to enforce a provision is not a waiver.
25.4 Assignment. You may not assign your rights; we may assign to an affiliate or in a corporate transaction.
25.5 Force Majeure. We are not liable for delays/failures due to events beyond reasonable control (e.g., natural disasters, war, sanctions, strikes, network outages, governmental actions).
25.6 Language. We may provide translations; in any conflict, the English version of these Terms and Conditions prevails unless local law requires otherwise.
Acceptance
By accessing or using the Platform, you acknowledge that you have read and agree to these Terms and Conditions and the incorporated policies.

1) من نحن وكيف تعمل هذه الشروط والأحكام
تُحدد هذه الشروط والأحكام ("الشروط") كيفية الوصول واستخدام موقع Skin Smart وتطبيقاته وخدماته المرتبطة (يشار إليها مجتمعة بـ "المنصة"). المنصة مملوكة لمؤسسة فاطمة عبد الله سعيد المداح التجارية، المسجلة في جدة، المملكة العربية.
عند إنشاء حساب، أو الشراء عبر المنصة، أو استخدام الميزات الاجتماعية/المجتمعية، أو التفاعل مع أدوات الذكاء الاصطناعي لدينا، فإنك توافق على هذه الشروط, سياسة الخصوصية, سياسة المجتمع والتواصل والتقييمات, سياسة الاستبدال والاسترجاع, سياسة ملفات الارتباط, أي سياسات أخرى مذكورة في المنصة, وأي شروط وأحكام خاصة بالميزات (بشكل جماعي"الإتفاقيات").

2) التعريفات
- الحساب: ملفك الشخصي المسجل في المنصة.
- المحتوى المجتمعي (UGC): أي محتوى تنشره او ينشره المستخدمون (صور، فيديوهات، تعليقات، تقييمات، رسائل خاصة، ملفات شخصية، روتينات عناية).
- متجر Skin Smart: المنتجات التي تبيعها وتوفرها Skin Smart مباشرة.
- الطلب: عملية شراء منتج عبر المنصة.
- RMA : ترخيص إرجاع منتج بعد الموافقة عليه.
- برنامج الولاء: برنامج المكافآت/المستويات الموضح في البند 16
3) نطاق التطبيق، الأهلية، الحسابات
3.1 النطاق واللغة: نخدم المستخدمين في المملكة العربية السعودية ودول الخليج. المنصة تدعم اللغتين العربية والإنجليزية.
3.2 الأهلية: يجب أن تكون قادرًا قانونيًا على إبرام عقد ملزم، وأن تبلغ الحد الأدنى للسن القانوني في منطقتك. بعض الميزات مخصصة لمن هم فوق 18 عامًا.
3.3 أمان الحساب: حافظ على سرية بيانات الدخول. أنت مسؤول عن كل نشاط يتم عبر حسابك. أبلغ عن أي اشتباه باختراق إلى: support@skinsmart.io
3.4 حساب واحد لكل شخص: يُمنع استخدام هويات مزيفة أو إنشاء حسابات متعددة بهدف تجاوز القيود أو التلاعب بالعروض.
4) طبيعة المنصة (وسيط تجاري)
4.1 وسيط سوق إلكتروني: باستثناء منتجات متجر Skin Smart، Skin Smart ليس الطرف البائع. البائعون المستقلون مسؤولون عن منتجاتهم وسياساتهم، وفقًا للحد الأدنى من معاييرنا.
4.2 المدفوعات والتسوية: نعمل كوسيط في الدفع, نجمع المبلغ الكامل من العميل, نخصم العمولة ثم نحول الباقي للبائع.
4.3 لا استشارات مهنية: مخرجات الذكاء الاصطناعي, المقالات, وصف المنتجات والمشاركات المجتمعية هي لأغراض تعليمية فقط, ولا تُعتبر نصائح طبية. دائما استشر مختصين عند الحاجة الى تشخيص.
5) استخدام المنصة
5.1 الاستخدام المسموح: لأغراض شخصية غير تجارية، إلا إذا منحناك إذنًا خطيًا مثل (المؤثرين/ الأدوات التابعة).
5.2 سلوكيات ممنوعة. انت موافق على أن لا:
- مخالفة القوانين أو انتهاك حقوق الغير (الخصوصية, الملكية الفكرية)
- نشر محتوى ضار أو تحريضي أو غير آمن
- إطلاق ادعاءات طبية أو تجميلية غير مٌثبتة
- الانخراط في الرسائل المزعجة, الاحتيال, انتحال الشخصية أو اختبارت الأمان غير المصرح بها
- تجاوز أو تعطيل أدوات الحماية أو فلاتر المحتوى
5.3 المتطلبات التقنية: تحتاج الى أجهزة وبرامج متوافقة واتصال بالإنترنت. يختلف الأداء حسب الجهاز والمنطقة.
5.4 التعليق/الإيقاف: قد نُقيّد أو نوقف وصولك للمنصة إذا انتهكت الشروط, أ, شكلت خطراً, أو لأسباب قانونية.
6) الأسعار، الدفع، والضرائب
6.1 الأسعار. الأسعار والعروض الترويجية قابلة للتغيير. قد تحدث أخطاء رغم بذل الجهد لتجنبها. إذا أثّر خطأ جوهري على طلبك، سنقوم بالتواصل معك لتأكيد السعر الصحيح أو إلغاء الطلب واسترداد المبلغ.
6.2 وسائل الدفع. تُعرض طرق الدفع المقبولة عند إتمام الشراء، مثل: البطاقات البنكية، المحافظ الإلكترونية، وبطاقات الهدايا.
6.3 العملات وأسعار الصرف. قد تختلف العملات المعروضة حسب موقعك. تُحدد أسعار الصرف من قبل مزودي خدمات الدفع وقت الخصم.
6.4 الضرائب والرسوم الجمركية. أنت مسؤول عن سداد الضرائب أو الرسوم الجمركية المطبقة، ما لم يُذكر خلاف ذلك أثناء الدفع.
7) الطلبات، القبول والتوافر
7.1 تكوين العقد. عند تقديمك لطلب شراء، يُعد ذلك عرضًا منك للشراء. يتم قبول الطلب عند شحن المنتج من قِبل البائع أو متجر Skin Smart، أو عند تأكيد القبول بشكل صريح.
7.2 التوافر. لا نضمن توفّر المنتجات بشكل دائم. في حال عدم التوفر أو وجود قيود، قد يتم إلغاء الطلب مع استرداد المبلغ.
7.3 حظر إعادة البيع. المنتجات مخصصة للاستخدام الشخصي فقط. قد نحدد كميات الشراء لكل شخص أو لكل طلب، وقد نلغي الطلبات المشتبه بإعادة بيعها.
8) الشحن وتحمل المخاطر
8.1 الشحن. تظهر خيارات الشحن، التكاليف، والمدة الزمنية أثناء الدفع، ويُمكن الاطلاع عليها في سياسة الشحن والتوصيل. إذا شملت الطلبات عدة بائعين، قد تُشحن بشكل منفصل.
8.2 انتقال المسؤولية. تنتقل مسؤولية المنتج إليك عند تسليمه إلى العنوان الذي قدمته أو عند استلامه. يُرجى فحص الطرد، ورفض الاستلام إذا ظهر عليه عبث أو تلف.
8.3 التأخير. لسنا مسؤولين عن التأخيرات الخارجة عن إرادتنا مثل (الجمارك، شركة الشحن، أو الظروف الطارئة). في حالة التأخير الطويل، قد تكون مؤهلًا لحلول بموجب القانون أو حسب سياسة الاستبدال والاسترجاع.
9) الإلغاء قبل الشحن
إذا رغبت في إلغاء طلبك قبل الشحن، يُرجى التواصل معنا على:Info@skinsmart.io خلال 3 ساعات من تقديم الطلب. إذا تم شحن الطلب، يُرجى الرجوع إلى سياسات الإرجاع (البنود 10 – 12).
10) الإرجاع، الاستبدال، والاسترداد – نظرة عامة
Skin Smart هي نقطة الاتصال الرئيسية، لكن يتطلب الأمر موافقة البائع في حال كانت المنتجات من بائع خارجي.
يُرجى مراجعة سياسة الاستبدال والاسترجاع المدمجة ضمن هذه الشروط لمزيد من التفاصيل.
10.1 من تتواصل معه. يمكنك التواصل مع Skin Smart أو البائع مباشرة. في جميع الحالات, Skin Smart ستنسق مع البائع, ولا يُنفذ الإرجاع أو الاسترداد دون موافقة البائع بالنسبة للمنتجات التي يوفرها.
10.2 المعايير الدنيا. يجب على البائعون قبول إرجاع المنتجات غير المفتوحة وغير المستخدمة والمؤهلة للإرجاع إذا تم الإبلاغ عنها خلال 7 أيام من الاستلام (تستثنى المنتجات ذات الطبيعة الصحية/الحميمية). بعض البائعين قد يقدمون شروطاً أكثر مرونة.
10.3 المنتجات التالفة/المعيبة/الخاطئة. إذا تم الإبلاغ عنها خلال 7 أيام مرفقة بالأدلة (صور أو فيديوهات), يتحمل البائع تكاليف الشحن ويقوم بالاستبدال أو الاسترداد بعد الفحص.
10.4 طريقة الاسترداد. تُرد المبالغ إلى نفس وسيلة الدفع بعد موافقة البائع, استلام المنتج وفحصه وفق تعليمات RMA , مدة ظهور المبلغ في الحساب تعتمد على البنك.
10.5 الهدايا, النقاط وبطاقات الهدايا. تُطبق قواعد خاصة بها, يمكن الرجوع إليها في سياسة الاستبدال والاسترجاع مثل:( إلغاء النقاط المكتسبة عند الإرجاع, أو إعادة الهدايا المرفقة).
10.6 لا تُرسل أي منتج بدون RMA. يُرفض الإرجاع في حال إرسال المنتج دون تصريح إرجاع رسمي أو إلى عنوان غير صحيح.
11) الطلبات الدولية والجمارك
11.1 المستورد الرسمي: بحسب وجهة الشحن وخيارات الدفع، قد تكون أنت أو البائع هو "المستورد الرسمي". قد يتم تحصيل الرسوم الجمركية والضرائب إما أثناء الدفع أو عند التسليم.
11.2 الالتزام بالقوانين: يتوجب عليك الالتزام بجميع قوانين الاستيراد الخاصة ببلدك. نحن غير مسؤولين عن أي مصادرة أو حظر أو فشل في سداد الرسوم الجمركية أو الضرائب المطلوبة.
12) معلومات المنتج والسلامة
12.1 الوصف: نحرص على دقة معلومات المنتجات، لكن قد تختلف بعض التفاصيل مثل التغليف أو التركيبة. يُرجى دائمًا مراجعة الملصق والتعليمات والتحذيرات على العبوة قبل الاستخدام.
12.2 التحسس والحساسية: قم بإجراء اختبار الرقعة قبل استخدام أي منتج. استشر المتخصصين إذا لزم الأمر. توقف عن استخدام المنتج في حال ظهور تهيج أو تحسس.
12.3 الادعاءات الطبية والتنظيمية: أي ادعاءات طبية متعلقة بالأداء تخضع للقوانين المعمول بها، ويجب أن تكون مدعومة من قِبل المُصنّع أو البائع. Skin Smart لا تضمن النتائج أو الفعالية.
13) ميزات الذكاء الاصطناعي وإخلاء المسؤولية
13.1 معلومات تعليمية فقط. كل ما يُعرض على المنصة، بما في ذلك الاقتراحات التي تقدمها أدوات الذكاء الاصطناعي أو المحتوى المخصص، يُعتبر لأغراض تعليمية فقط ولا يُعدّ نصيحة طبية.
13.2 لا قرارات قانونية آلية. لا تعتمد المنصة على قرارات ينتج عنها أثر قانوني مباشر دون مراجعة بشرية.
13.3 خياراتك كمستخدم. يمكنك الاعتراض على "الملف التعريفي" (profiling)، طلب مراجعة بشرية، أو تعديل تفضيلات التخصيص من خلال الإعدادات (يرجى مراجعة سياسة الخصوصية).
14) المجتمع، التواصل، والمراجعات
14.1 السياسة المدمجة: سياسة المجتمع والتواصل والمراجعات تُعد جزءًا من هذه الشروط، وتشمل: من يحق له النشر، جودة المحتوى، المحتوى المحظور، قواعد الرسائل المباشرة، الإفصاح عن الهدايا/الإعلانات/الروابط التابعة، وتضارب المصالح، وآليات الإشراف.
14.2 ترخيص المحتوى لـ Skin Smart:بنشرك أي محتوى مستخدم (UGC)، تمنح Skin Smart ترخيصًا عالميًا، غير حصري، مجاني، قابل للنقل والترخيص من الباطن لاستخدام هذا المحتوى، بما في ذلك تخزينه، عرضه، نسخه، توزيعه، تكييفه، ترجمته، أو استخدام مقتطفات من المحتوى الذي أنشأته بواسطة المستخدم فيما يتعلق بالمنصة والترويج لها.
14.3 لا التزام بالمراقبة. قد نقوم بمراقبة أو تعديل المحتوى، لكننا لسنا ملزمين بذلك. لنا الحق في إزالة المحتوى أو تقييد الحسابات في أي وقت.
14.4 رد العلامات التجارية. يحق للعلامات التجارية الرد على المراجعات. قد نطلب إثبات الشراء أو معلومات إضافية قبل اتخاذ القرار بالاحتفاظ, التعديل مع الاقتصار على التعديلات الطفيفة (إملائية/نحوية فقط)، وضع علامة او إزالة أي مراجعة.
14.5 الملكية. تظل ملكية المحتوى الذي تنشره لك، ولكنك تقر بأن لديك كافة الحقوق والصلاحيات القانونية لنشره (بما في ذلك حقوق الصور الشخصية إن وُجدت).
15) الملكية الفكرية وترخيص استخدام المنصة
15.1 ملكية Skin Smart المنصة وجميع ما تحتويه من شيفرات، شعارات، علامات تجارية، تصاميم، نصوص، ومحتويات، مملوكة لSkin Smart أو الجهات المرخصة لها، ومحميّة بموجب القوانين.
15.2 تراخيص محدود لك. نمنحك ترخيصًا غير حصري، غير قابل للنقل، وقابل للإلغاء لاستخدام المنصة لأغراض شخصية وغير تجارية، وفقًا لهذه الشروط.
15.3 القيود. يُمنع نسخ أو توزيع أو عكس هندسة الشيفرات، أو استخراج البيانات، أو إنشاء أعمال مشتقة دون إذن كتابي مسبق، (إلا في الحالات التي يسمح بها القانون).
16) تحديد المسؤولية وحل النزاعات
16.1 دور Skin Smart كوسيط. تعمل Skin Smart كمنصة رقمية تربط بين المستخدمين بالبائعين الخارجيين. بإستثناء المنتجات التي تباع مباشرة من متجر (Skin Smart), Skin Smart لا تقوم بتصنيع, أو تخزين, أو تجهيز أو شحن أي منتج. البائعون الموجودون في المنصة هم الممثلون والمسؤولون الوحيدون عن عمليات التوصيل وبيع وضمان منتجاتهم.
16.2 نطاق مسؤوليتنا. تقتصر Skin Smart مسؤوليتها على:
أ. تقديم البنية التحتية التقنية لتصفح وشراء المنتجات والتواصل مع البائعين.
ب. معالجة عمليات الدفع وتحويل الأموال للبائعين.
ت. تنسيق عمليات الإستبدال والاسترداد بين البائعين والمستخدمين.
ث. الحفاظ على قنوات دعم العملاء والوساطة في النزاعات.
يقتصر دور Skin Smart على الوساطة والإدارة فقط. لا تتولى المنصة ملكية أو إدارة أو حفظ المنتجات التي يبيعها البائعين في أي مرحلة من مراحل المعاملة.
16.3 مسؤولية البائع. كل بائع موجود على منصة Skin Smart هو تاجر مستقل مؤوول عن:
أ. دقة قوائم المنتجات, أوصافها, أسعارها وتوافرها؛
ب. الالتزام بقوانين وضع العلامات على المنتجات وسلامتها واستيردها وحماية المستهلك؛
ت. التسليم, والشحن, والتنفيذ (بما في ذلك التأخير, والتخليص الجمركي, أو مشاكل التوصيل) أو؛
ث. إدارة ضمانات المنتجات, وعمليات الإستبدال, والإرجاع وفقاً لسياساتها والقوانين المعمول بها.
يجب حل أي نزاعات تتعلق بهذه المسائل مباشرةً بين العميل والتاجر. ستسهل Skin Smart التواصل, لكنها لا تمثِّل أياًّ من الطرفين في مثل هذه النزاعات.
16.4 لا مسؤولية مشتركة. لا تتحمل Skin Smart المسؤولية بشكل مشترك أو فردي عن:
أ. عيوب أو تلف في المنتجات, أو جودتها؛
ب. تأخير التوصيل أو مشاكل شركات الشحن؛
ت. معلومات خاطئة مقدمة من البائع عن المنتج؛
ث. إخلال التاجر بإلتزامه بموجب القوانين المعمول بها؛
ج. الأضرار الناجمة عن استخدام أي موقع ويب تابع لجهة خارجية أو روابط خارجية؛ أو
ح. أي أضرار غير مباشرة, أو عرضية أو عقابية أو لاحقة, بما في ذلك خسارة الأرباح أو البيانات أو السمعة الطيبة, الناشئة عن استخدام المنصة أو المنتجات التي تم شراؤها من خلالها.
تٌخلي Skin Smart مسؤوليتها عن جميع الضمانات, الصريحة أو الضمنية, فيما يتعلق بالمنتجات التي يبيعها البائعون, بما في ذلك على سبيل المثال لا الحصر قابلية التوسويق والملاءمة لغرض معين ودعم الانتهاك.
16.5 الذكاء الاصطناعي وإلاء المسؤولية. المعلومات, وتوصيات المنتجات, ونصائح العانية بالبشرة المقدمة من خلال ميزات الذكاء الاصطناعي في تطبيق Skin Smart مقدمة لأغراض إعلامية وتعليمية فقط, ولا تعتبر نصائح طبية. يُنصح المستخدمون بإستشارة أطباء جلدية أو متخصصين في الرعاية الصحية قبل اتخاذ أي إجراء بناءً على أي محتوى أو توصيات مقدمة من خلال الذكاء الاصطناعي. Skin Smart غير مسؤولة عن أي اعتماد على هذا المحتوى.
16.6 الدفع والاسترداد. تقوم Skin Smart بتحصيل المدفوعات نيابةً عن البائعين كوسيط دفع. بمجرد تأكيد الدفع, تقتصر مسؤولية Skin Smart على تحويل المبلغ المقابل (بعد خصم العملولات) إلى البائع. لن تتم معالجة عمليات الاسترداد أو الاستبدال إلا بعد موافقة البائع. في جميع الحالات, تقتصر المسؤولية المالية لـ Skin Smart على إجمالي العمولة المكتسبة من العملية محل النزاع.
16.7 الاختصاص القضائي والقانون المعمول به:
أ. جميع النزاعات أو المطالبات أو الخلافات الناشئة عن استخدام منصة Skin Smart، بما في ذلك مسائل الدفع أو حسابات المستخدمين أو حماية البيانات، تقع ضمن الاختصاص القضائي الحصري لمحاكم جدة، المملكة العربية السعودية، وتخضع للقانون السعودي.
ب. تخضع النزاعات المتعلقة بأداء المنتج، أو تسليمه، أو إرجاعه، أو ضماناته لقوانين واختصاص مكان إقامة التاجر، ما لم يتم الاتفاق على خلاف ذلك بين العميل والتاجر.
16.8 التعويض. يتفق المستخدمون وتجار التجزئة على تعويض Skin Smart والشركات التابعة لها ومسؤوليها وموظفيها ووكلائها والدفاع عنها وحمايتها من أي مطالبات، أو خسائر، أو التزامات، أو أضرار، أو تكاليف أو نفقات (بما في ذلك الرسوم القانونية المعقولة) الناشئة عن أو المتعلقة بما يلي:
أ. أي خرق لهذه الشروط والأحكام أو أي اتفاقيات أخرى سارية؛
ب. أي إساءة استخدام للمنصة، بما في ذلك أي نشاط غير قانوني أو احتيالي؛
ت. أي انتهاك للقوانين واللوائح المعمول بها أو حقوق الأطراف الثالثة؛
ث. أي محتوى أو مواد أو محتوى من إنشاء المستخدم (UGC) مُقدم أو مُشارك عبر المنصة؛
ج. أي نزاع أو مطالبة أو معاملة بين مستخدم وبائع تجزئة أو بين المستخدمين أنفسهم.
16.9 تحديد الأضرار. إلى الحد الأقصى الذي يسمح به القانون، فإن إجمالي المسؤولية التراكمية لشركة Skin Smart تجاه أي مستخدم أو بائع تجزئة عن أي مطالبة تنشأ عن المنصة أو تتعلق بها، سواء في العقد أو الضرر أو غير ذلك، لا يتجاوز إجمالي العمولة التي تلقتها شركة Skin Smart عن المعاملة المحددة التي أدت إلى المطالبة.
17) برنامج الولاء (نظرة عامة)
دمج السياسة. تعتبر شروط برنامج الولاء جزءًا لا يتجزأ من هذه الشروط والأحكام.
17.1 العضوية. قد يتم تسجيلك تلقائيًا في برنامج الولاء عند إنشاء حساب، أو يمكنك الانضمام إليه يدويًا باختيارك. يُسمح بحساب واحد فقط لكل شخص.
17.2 الفئات والمزايا. قد تُقدم Skin Smart فئات مختلفة ضمن البرنامج (Smart, Smarter , Smartest),بحيث تختلف المزايا باختلاف الفئة (تجميع النقاط، مزايا خاصة، عروض من الشركاء).
17.3 النقاط . النقاط ليس لها أي قيمة نقدية، لا يمكن تحويلها وقد تكون خاضعة لفترة صلاحية تنتهي بعدها. قد تكون هناك قواعد لاستخدام النقاط (مثل: إمكانية استخدام حتى 50% للطلب الواحد فقط).
17.4 التعديلات. قد تحتفظ Skin Smart بحق إضافة أو تغيير أو إلغاء أي من الفئات أو مزايا البرنامج أو آلية تجميع النقاط في المستقبل مع إشعار المستخدمين. أي إساءة (الاحتيال، التلاعب، أو إعادة البيع) قد تؤدي إلى فقدان النقاط، أو إلغاء العضوية، أو اتخاذ إجراءات ضد الحساب.
17.5 المرتجعات. في حالة إرجاع منتج تم شراؤه باستخدام نقاط، يتم إعادة النقاط لحسابك إن كان ذلك ممكنًا.
أي نقاط إضافية تم الحصول عليها نتيجة الشراء المُعاد، قد يتم إلغاؤها عند إرجاع المنتج.
18) الخدمات الخارجية (الطرف الثالث)
قد تتضمن المنصة روابط إلى مواقع خارجية أو أدوات (مثل: أدوات الدفع، التحليلات، أو خدمات المراسلة).
لا تتحمل Skin Smart أي مسؤولية عن شروط استخدام أو سياسات المواقع الخارجية. محتواها أو تصرفاتها.
ننصحك بمراجعة الشروط والأحكام الخاصة استخدامها.
19) إخلاء المسؤولية وعدم تقديم أي ضمانات
إلى أقصى حد يسمح به القانون، تُقدم المنصة وجميع ميزاتها (بما في ذلك الذكاء الاصطناعي والمجتمع) "كما هي" و"كما هي متاحة" دون أي ضمانات من أي نوع، صريحة كانت أم ضمنية، بما في ذلك قابلية التسويق، والملاءمة لغرض معين، والملكية، وعدم التعدي. لا نضمن التشغيل المتواصل أو الخالي من الأخطاء أو الآمن، ولا نضمن تحديد أو إزالة أي محتوى ضار أو غير قانوني.
20) الخصوصية وملفات تعريف الارتباط (الكوكيز)
يخضع استخدامك للمنصة لسياسة الخصوصية وسياسة الكوكيز الخاصة بنا، واللتين توضحان كيف نقوم بجمع واستخدام ومشاركة ونقل وحماية بياناتك الشخصية، بما في ذلك ما تتم مشاركته مع البائعين أو مزودي الخدمات.
يمكنك إدارة تفضيلات الكوكيز الخاصة بك من خلال إعدادات المتصفح أو الجهاز الخاص بك.
21) الأمان وسلامة المستخدم
نطبق إجراءات حماية تتوافق مع سياسة أمن الإنترنت لدينا. أنت مسؤول عن الحفاظ على أمان جهازك، واستخدام كلمات مرور قوية، وتجنب التصيد الاحتيالي أو الروابط المشبوهة. أبلغ عن أي احتيال مشتبه به عبر البريد الإلكتروني support@skinsmart.io
22) التعديلات على المنصة أو الشروط
قد نقوم بتحديث الميزات، السياسات أو هذه الشروط والأحكام لتتماشى مع المتطلبات القانونية أو لتحسين الخدمات. سننشر التحديثات مع تحديد "تاريخ النفاذ".
استمرارك في استخدام المنصة بعد تاريخ دخول التعديلات حيّز التنفيذ يُعد موافقةً ضمنيةً منك على تلك التعديلات.
23) القانون الواجب التطبيق والاختصاص القضائي
تخضع هذه الشروط والأحكام لقوانين المملكة العربية السعودية. أنت توافق على أن تكون محاكم مدينة جدة هي المختصة حصريًا في النظر بأي نزاع ينشأ عن استخدامك للمنصة. وذلك دون المساس بأي حقوق استهلاكية إلزامية لا يمكن التنازل عنها في دول أخرى، إن كانت تنطبق.

25) أحكام عامة
25.1 الاتفاق الكامل. تشكل هذه الشروط والأحكام، بالإضافة إلى السياسات المدمجة فيها، الاتفاق الكامل والنهائي بينك وبين Skin Smart بشأن استخدام المنصة.
25.2 قابلية الفصل. في حال تبين أن أي بند من هذه الشروط غير صالح قانونيًا، تظل بقية البنود سارية المفعول.
25.3 عدم التنازل. عدم تطبيقنا لأي بند لا يعني التنازل عن الحق في تطبيقه لاحقًا.
25.4 عدم التنازل أو التحويل. لا يمكنك التنازل عن أي من حقوقك بموجب هذه الشروط. أما نحن، فقد نقوم بتحويل حقوقنا إلى جهة تابعة لنا أو في إطار صفقة تجارية.
25.5 القوة القاهرة. نحن غير مسؤولين عن أي تأخير أو فشل في تنفيذ الالتزامات الناتجة عن أحداث خارجة عن إرادتنا المعقولة (مثل الكوارث الطبيعية، الحروب، العقوبات، الإضرابات، انقطاع الإنترنت، أو التدخل الحكومي).
25.6 اللغة. قد نوفر ترجمة لهذه الشروط بلغات متعددة، ولكن في حال التضارب في المعنى، تسود النسخة الإنجليزية ما لم يفرض القانون المحلي خلاف ذلك.

بدخولك واستخدامك لمنصة Skin Smart، فإنك تقر بأنك قد قرأت وفهمت ووافقت على الالتزام بهذه الشروط والأحكام والسياسات المدرجة فيها.
